Welcome to CardCraft NZ, operated by Legend Incorporation Limited (“we”, “us”, “our”).

By accessing or using our website and services (the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please stop using our Services immediately.

1. Service Description

CardCraft NZ provides custom metal card conversion services for existing debit and credit cards owned by the customer.

We are not a financial institution and do not:

  • Issue payment cards or accounts
  • Perform credit checks
  • Provide banking or financial services
  • Store or access customers’ financial information
  • Assume liability for the functionality of your original card

We simply create a new metal card and transfer your existing chip onto it.

2. Customer Responsibilities & Warranties

By using our Services, you confirm that:

  • You are the legitimate owner of the card being converted
  • You have obtained all necessary permissions from your card issuer or financial institution
  • You understand that converting your card may void your bank’s or manufacturer’s warranties
  • You are solely responsible for ensuring that the converted card complies with your card issuer’s terms
  • You are at least 18 years old and legally capable of entering this agreement

3. Important Information About Your Card

  • Your metal card will expire when your original card expires. We recommend converting a card with the longest expiry date.
  • We do not store or record any financial information.
  • Before sending your card to us, you must freeze or block it with your card issuer to prevent unauthorized use.
  • If you choose the DIY chip transfer option, you take full responsibility for any damage that occurs during the process.
  • Metal cards cannot be used in ATMs. Inserting your card into an ATM may damage the machine, and any resulting cost or liability is solely yours.
  • Your metal card will not support contactless (“payWave”) payments. You can still use your phone’s wallet for wireless transactions and your metal card for chip or online payments (if these were previously enabled).
  • None of your existing features, loyalty points, or benefits will change. They remain governed by your card issuer’s terms.

4. Chip Transfer Options

Option A – DIY Transfer:

  • We provide instructions to install the chip yourself.
  • You assume full responsibility for a successful chip transfer.
  • We are not liable for chips damaged or rendered unusable during customer installation.

Option B – Full Service Transfer:

  • You may send your original card to us for chip transfer.
  • Shipping your card is at your own risk.
  • We will complete the transfer with reasonable skill and care, but our liability is limited to the cost of the metal card itself.

5. Orders, Payment & Refunds

All orders must be placed through our website only cardcraft.co.nz.

Full payment is required at the time of order. Production begins only once payment is received.

Because each card is custom-made and engraved, all sales are final. We do not offer refunds or cancellations after an order is confirmed.

Refunds will not be issued for:

  • Customer errors (wrong card details, spelling mistakes, incorrect card sent)
  • Change of mind
  • Normal wear, scratches, or cosmetic damage

We may, at our discretion, replace a card only if it arrives damaged or defective due to our workmanship.

6. Shipping & Risk

  • We currently ship within New Zealand only.
  • Shipping times are estimates and may vary.
  • Risk passes to you once the item is dispatched.
  • We are not responsible for courier or postal delays, loss, or incorrect delivery caused by customer error.
  • Signature may be required upon delivery.

7. Limitations & Disclaimer of Warranties

Critical Limitations:

  • Metal cards do not support contactless payments.
  • Card functionality depends on your chip remaining undamaged.
  • Some payment terminals may not accept metal cards.
  • Appearance may differ slightly from digital images.

Warranty Disclaimer:

All services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Compatibility with all payment systems

8. Limitation of Liability

To the maximum extent permitted by New Zealand law, CardCraft NZ and Legend Incorporation Limited’s total liability for any claim is limited to the purchase price paid for the metal card.

We are not liable for:

  • Financial losses or unauthorized transactions
  • Loss of card functionality
  • Costs charged by your bank to replace your card
  • Consequential, incidental, or indirect damages
  • Travel delays or costs caused by card malfunction

You use our products entirely at your own risk.

9. Payment Card Security

While our cards are designed with security in mind (no wireless capability), you acknowledge that:

  • Ultimate responsibility for card security lies with you and your bank.
  • We cannot guarantee protection against all forms of fraud or skimming.
  • You must report any suspicious activity directly to your card issuer.

10. Intellectual Property

All designs, text, images, and logos on this website are the property of Legend Incorporation Limited.

You may not copy, reproduce, distribute, or create derivative works without our written permission.

11. Consumer Guarantees Act 1993

Nothing in these Terms excludes or limits your rights under the Consumer Guarantees Act 1993.

If you purchase goods for personal use, you have statutory guarantees that cannot be excluded.

12. Indemnification

You agree to indemnify and hold harmless CardCraft NZ, Legend Incorporation Limited, and all related directors, employees, and agents from any claim, damage, or expense arising from:

  • Your breach of these Terms
  • Unauthorized use of any payment card
  • Misuse of converted cards
  • Violation of your bank or card issuer’s rules

13. Termination

We may suspend or terminate your access to our Services at any time if you breach these Terms.

All provisions that should survive termination (including warranty disclaimers and limitations of liability) will remain in effect.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of New Zealand.

Both parties agree to attempt mediation before commencing legal proceedings. Any unresolved disputes will fall under the exclusive jurisdiction of New Zealand courts.

15. Changes to These Terms

We may update these Terms at any time. The new version will take effect immediately upon publication on our website.

Continued use of our Services after updates constitutes acceptance of the revised Terms.
